Marilyn Mosby’s Lawyers Challenge Sentencing Guidelines in Mortgage Fraud Case

BALTIMORE — In a fresh court filing, lawyers have disputed the sentencing guidelines in Marilyn Mosby’s mortgage fraud case, according to an objection lodged in federal court.

Mosby, having been convicted of perjury and mortgage fraud, could face up to 40 years in federal prison; however, she is unlikely to receive the maximum sentence. Federal prosecutors are recommending a 20-month sentence for the former Baltimore’s state’s attorney, but her attorneys believe she should avoid prison entirely.

In their objection, Mosby’s attorneys refer to 18 U.S.C. § 3553, which lays down factors the courts must take into account when handing down a sentence.

“Ms. Mosby was charged and convicted because she opted to repeatedly violate the law, not due to her political or policy stances,” Assistant U.S. Attorneys Sean Delaney and Aaron Zelinsky noted in a sentencing memorandum.

In two separate trials, Mosby was found guilty of lying about a vacation home mortgage and COVID-related hardship withdrawals from her retirement account. Recently, prosecutors requested to confiscate Mosby’s Florida condo, which they claim was bought using a fraudulent mortgage loan.

Mosby’s sentencing will occur on May 23.
