The Heartbreaking Loss of a Child

Tabatha Toy is forever grieving her daughter Tina, who died in 2016 following an emergency room visit at Brockton’s Good Samaritan Medical Center. Tina, identical twin to Jasmine, was born with Down Syndrome. Despite this, both girls were thriving until Tina fell ill with a seizure.

Medical Negligence Accusations

Medical records reveal that Tina presented with a high fever, elevated heart rate, strep, and brain swelling. Despite her deteriorating condition and visible distress, Toy alleges the hospital staff ignored them. “I feel like we were just put to the side and forgotten. They didn’t care about my daughter,” Toy said.

Legal Delays and Bankruptcy Complications

Toy filed a wrongful death lawsuit against Good Samaritan, a Steward Health Care facility, in 2019. However, the case is just one among many, including medical malpractice and wrongful death lawsuits, against Steward now on hold due to its bankruptcy.

Kathryn Wickenheiser, the attorney representing the Toy family, is frustrated. “This case should have been resolved and this family should have closure,” she said. She pinpointed the hospital staff as stretched thin and unresponsive on the day of Tina’s visit.

Tina’s Case and The Ongoing Fight for Justice

The lawsuit indicates that Tina stopped breathing multiple times at Good Samaritan. She was eventually transferred to a Boston hospital but had already suffered major brain damage. Tina was removed from life support the following day, her official cause of death being a viral upper respiratory infection compounded by MRSA pneumonia.

“I want closure, I just want them to be held accountable so they can’t hurt anybody anymore,” Toy stated. Despite these hopes, the case’s mediation is uncertain due to Steward’s bankruptcy and denial of allegations.
