As Privacy law enforcement continues to increase, businesses must stay prepared. In 2025, privacy fines in the US totalled $3.4 billion, a significant leap from $1.8 billion in 2024, as revealed in a recent Gartner report.

The increase in fines reflects a surge in state enforcement action. Businesses, regardless of size or industry, from healthcare, finance, to entertainment, are affected. The penalties result from state fines and lawsuits as companies are expected to comply with consumer rights and data protection laws. Gartner predicts that more states will pass privacy legislation in the coming years.
Expanding Regulations on AI Use
State regulations on AI use are also increasing. Last year alone, over 100 state laws addressing artificial intelligence were passed. As an industry leader in privacy enforcement, California established new rules for automated decision-making in job recruitment and employment.

Nader Henein, an analyst at Gartner, emphasizes the importance of companies updating their privacy policies. Many businesses established their privacy program when California first passed its privacy law in 2018. This significant law allows consumers to know, delete, and opt out of personal information sharing.

With the rising compliance costs, Congress may take notice. However, a federal law to supersede state laws does not seem likely in the near future. This leaves businesses navigating a mosaic of state laws.
