Judge McAfee Decrees DA Willis May Proceed as Prosecutor in Election Interference Case
TL/DR –
Judge McAfee has decided that, if District Attorney Fani Willis wishes to continue prosecuting the case against Donald Trump and his allies, the special prosecutor Nathan Wade must withdraw due to potential impropriety. If Wade refuses to step down, Willis would have to remove herself and her office from the proceedings. DA Willis and the defendants could potentially appeal Judge McAfee’s ruling, but this would not prevent the charges from proceeding to trial at this time.
Judge McAfee Sets Boundaries in Election Interference Case
Judge McAfee outlined specifics of his decision regarding the case against Donald Trump and his allies. If District Attorney (DA) Fani Willis desires to proceed with the prosecution, special prosecutor Nathan Wade must withdraw due to possible impropriety perception. Failing this, DA Willis and her office would have to step aside, assigning a new prosecutor by the Georgia State Prosecuting Attorneys’ Council.
Decision Made After In-Person Hearing
The decision was made following several briefings and a two-and-a-half day in-person hearing, which included testimonies from DA Willis and special prosecutor Nathan Wade, and other supporting evidence presented by the defendants’ lawyers.
Possibility of Appeal
DA Willis and the defendants who submitted the disqualification motion against her may possibly appeal Judge McAfee’s ruling. However, the Judge needs to expressly authorize such appeal at this stage in the case – otherwise, it can only be appealed after a verdict is reached. This ruling does not prohibit the charges against Trump and his allies from advancing to trial.
