Chief Justice Roberts Denounces “Illegitimate Activity” Undermining Judicial Independence

Chief Justice John Roberts expressed concern over “illegitimate activity” threatening the judiciary’s independence in his annual end-of-year report. He flagged violence, intimidation, disinformation, and defiance of court judgments as primary concerns.

According to Roberts, such actions “undermine our Republic” and are unacceptable. The Supreme Court, holding a 6-3 conservative majority, has been under scrutiny following the 2022 landmark ruling to abort Roe v. Wade case’s decades-long rights.

This ruling led to protests outside the homes of justices, with one man charged with attempted murder after an arrest outside Justice Brett Kavanaugh’s home.

Democrats in Congress have renewed their attention to the court following media reports of alleged ethics lapses from some justices, notably conservative Justice Clarence Thomas.

In his report, Roberts revealed that violent threats against judges have tripled in the past decade, resulting in attacks and even deaths of several judges or their family members.

He also highlighted growing problems from intimidation, including protesters harassing judges, and public officials implying political bias in judges’ adverse rulings without credible basis. Roberts stressed that attempts to intimidate judges are inappropriate and should be firmly opposed.

He additionally pointed to disinformation, fueled by social media and foreign governments, as a threat that can erode confidence in the court system. Roberts insisted that calls from politicians advocating the defiance of court rulings should be “soundly rejected”.

The Chief Justice is part of the conservative majority that has issued a string of rulings met with strong opposition from the left, including decisions ensuring President-elect Donald Trump would avoid an election interference trial before the election, and rulings limiting federal agencies’ power on issues like environmental and consumer protection.

With President Trump set to take office again and pledging to pursue policies prone to legal challenges, the Supreme Court’s scrutiny is likely to persist.
