Judge Gregory Carro, presiding over Mangione’s state criminal case, stated that the evidence presented was insufficient to sustain the terrorism-related charges. He made this assertion in a written decision posted during a short proceeding in Manhattan court.
In addition to the murder charges, Mangione is also facing federal charges for allegedly shooting Thompson outside a hotel, along with weapons possession counts.
Mangione’s defense argued that he should not be tried twice for the same crime in both state and federal court — a concept known as double jeopardy. Judge Carro, referencing a supreme court decision, rejected this argument.
To address concerns over Mangione’s right against self-incrimination, Carro rejected the defense’s request to postpone the state case until after the federal trial.
