Genesis Healthcare’s Liquidation Plan Approved; Creditors to Recover $1 Billion
TL/DR –
The US Bankruptcy Court for the Northern District of Texas has confirmed the Chapter 11 liquidation plan of Genesis Healthcare, enabling the sale of the company and the recovery of $1 billion for the bankruptcy estate. Genesis, which filed for bankruptcy for its 299 debtor affiliates in 2025, initially planned to sell their facilities to an insider, which would have left unsecured creditors without recovery on over $1.3 billion in claims. A settlement approved by the court in September 2026 brought an additional $150 million in payments to the estate and wiped out nearly $430 million in secured and unsecured claims.
U.S. Bankruptcy Court Approves Genesis Healthcare Chapter 11 Plan, Unsecured Creditors to Recover $1 Billion
On October 14, 2026, Genesis Healthcare, Inc.’s Chapter 11 liquidation plan was confirmed by the U.S. Bankruptcy Court for the Northern District of Texas. The confirmation facilitated a company sale, leading to a bankruptcy estate recovery of $1 billion, bringing significant relief to creditors. The sale process, led by the Official Committee of Unsecured Creditors represented by Stinson LLP, was accepted by 98% of unsecured creditors.
Genesis Healthcare’s Bankruptcy Journey
Genesis, operating 175 skilled nursing facilities across 18 states, filed for bankruptcy in July 2025 for 299 debtor affiliates. An initial plan involved selling their facilities to an insider, which would have left unsecured creditors with no recovery from over $1.3 billion claims. However, after a challenge by the Committee, U.S. Bankruptcy Judge Stacey Jernigan reopened the sale. As a result, West State Street, a NewGen affiliate, emerged with a winning $1 billion bid.
Settlement Approval Increases Estate Payments
In September 2026, a settlement between Genesis, its secured creditors, and controlling investors was approved. This brought an additional $150 million payments into the estate and eliminated nearly $430 million in secured and unsecured claims. “Our goal was to maximize value for unsecured creditors through a fair and competitive process. The result was a monumental recovery for creditors, and we are pleased with the outcome”, said Stinson Partner Nick Zluticky.
Legal Representation
