In a recent development, the trial for a woman accused of murder and arson in Kingston has been postponed indefinitely. The delay comes as the defense team seeks to evaluate her mental health, as revealed in court documents.

Who is the Accused?

Lisa M. Starruick-Smalls, a 61-year-old woman from Kingston, has been charged with setting her apartment at the Green Acres Apartments on fire in the early hours of January 4, 2023. The tragic incident led to the death of her 74-year-old husband, Wilbert Smalls.

Trial Delays

Slated to commence on December 16 under Luzerne County President Judge Michael T. Vough, the trial has since been canceled. The cancellation follows the recent approval by the judge of a petition filed by defense lawyer, Thomas S. Cometa, seeking a mental health competency evaluation for the defendant.

Mental Health Concerns

The trial has experienced significant delays due to ongoing concerns about Starruick-Smalls’ mental health. The defense team’s concerns escalated after a proposed deal by the Luzerne County District Attorney, which would allow her to plead guilty to third-degree murder and arson in return for an agreed-upon 24-48 years’ sentence, fell apart.

Details of the Incident

According to the prosecution, Starruick-Smalls lit a fire in her art room while smoking a cigarette and having a beer. Allegedly, she placed a pot of oil on a stovetop with the burner set to high, and then set a fur coat and a bag of toilet paper on fire.

After the fire was set, she reportedly stepped outside to smoke a cigarette, leaving her sleeping husband alone in the burning apartment, according to charges. Mr. Smalls succumbed to smoke inhalation, and the manner of death was ruled a homicide.

Post-Arrest Statement

Succinctly expressing her position after the arrest, Starruick-Smalls made an unprovoked statement to reporters: “Guilty. Life. Death sentence. I own it.” She continues to be held without bail at the Luzerne County Correctional Facility while her case is pending resolution.
