Brown was arrested after an extensive investigation, having been charged with second-degree felony homicide. The Pensacola News Journal reported that the victim showed signs of lidocaine toxicity during the procedures, which included a muscle repair, abdominal scar revision, bilateral arm liposuction, and a lip injection.

The Florida Health Department concluded that Brown delayed calling 911 when his wife became unresponsive and started CPR after 10 minutes. Furthermore, he engaged in medical malpractice by performing unauthorized procedures and disregarding sterility protocols.

The Santa Rosa County Sheriff’s Office is investigating the cause and manner of Hillary’s death. An autopsy protocol is awaited from the medical examiner’s office, involving extensive laboratory and toxicology tests. Hillary’s father, Marty Ellington, stated his daughter died due to “one careless individual,” blaming Benjamin Brown for her death.
