According to the lawsuit, Firefighter Yolanda McKay was overlooked for the role in 2017 due to the discriminatory nature of the test. Despite this initial setback, she managed to secure the position in 2022, two years after the city amended its physical fitness test. However, the time lost due to the old test had already inflicted significant damage on her career advancement and earnings.

Christine Scott’s Unsuccessful Attempt at Joining the Firefighting Force

Christine Scott of North Royalton faced a similar predicament. She took the said test, but her application was unsuccessful. While the city has since changed the test, the lawsuit argues that many prospective women firefighters were unjustly passed over due to the unfair test conditions.
